If you've been keeping track of the latest news, you may have already heard that the culprit who leaked the Hulk Hogan sex tape has been found.

But what you may not know is that criminal charges cannot be filed.

Who are the People Involved?

• Hulk Hogan (real name Terry Bollea)

Legendary wrestler, divorced from Linda Hogan as of 2007, and married to Jennifer McDaniel since 2010. Hogan has 2 adult children, a 24-year-old daughter, Brooke, and a 22-year-old-son, Nick.

• Heather Clem

Married to DJ, Bubba the Love Sponge, Hogan's best friend, until their separation in 2010. Hulk Hogan was the best man at their wedding in 2007. Bubba and Heather were divorced in 2011.

• Bubba the Love Sponge (Todd Alan Clem)

A Florida-based radio DJ and long-time best friend of Hulk Hogan. Bubba covered the early days of Hogan's wrestling career on radio, and did many exclusive backstage interviews with him at his matches.

• A former Sirius XM Radio staff member

This anonymous person was formerly employed by Bubba when he worked for Sirius XM Radio. When Bubba abruptly left Sirius XM to return to Terrestrial Radio, this employee and several others found themselves unpaid, and unemployed.

What Happened?

The scandal began when Gawker.com posted on its website a 1-minute clip from a sex tape 30 minutes long featuring wrestling legend Hulk Hogan that was given to them for free by an anonymous source.

• The sex tape, which was taken 6 years ago, shows Hulk Hogan having sex with Heather Clem, the ex-wife of "Bubba the Love Sponge" who is Hulk Hogan's best friend. Hulk and Bubba were both married at the time and Hulk had Bubba's permission to bed his wife.

• Hulk Hogan's had his attorney send Gawker a cease-and-desist letter to the website, demanding that they take immediately take the embarrassing sex tape footage down.
  

• The grainy sex tape appears to have been taken with a security camera, and was done without Hulk Hogan's knowledge or permission.

• The Hulk Hogan sex tape was shopped around to the highest bidder earlier this year by someone (not Hulk or Bubba). Screen grabs hit the Internet in April, but video footage only surfaced recently.

• Heather Clem, is said to have had a long-term obsession with Hulk Hogan and talked about wanting to have sex with him for at least 2 years. Heather and Bubba (who are into swinging, wife-swapping, etc,) were finally able to get Hulk to agree to fulfill Heather's fantasy. Hulk Hogan had no idea that the session was being taped by Bubba for Heather's personal pleasure.

• It was first thought that Bubba, Heather, or someone in their household might have leaked the tape.

• Apparently Bubba showed the Hulk Hogan sex tape to employees of his behind Hogan's back when he worked for Sirius radio, and wasn't too careful about securing the tape.

• It now turns out that a disgruntled, the one mentioned above, decided to exact revenge on Bubba by getting hold of, and releasing the tape, thus destroying a long-term friendship between the two men.

• According to the Wrestling Observer, the state's attorney concluded no criminal charges can be pressed because no crime was actually committed.

• Rumor has it that it's possible Hogan knew he was being taped and was okay with it because of the people involved were his friends, or that he had no idea he was being taped, found out later and put legal threats in place. (The sex tape was made in 2006, and Hogan was said to have found out about it in 2009)

• Hulk Hogan has warned his family that this may not be the only time he was taped having sex with someone else, and that there's a strong possibility that other sex tapes may emerge.

• Hogan says the sex tape was made at a low point in his marriage to Linda Hogan, whom he divorced in 2007, and that this is the most embarrassing thing he's ever had to deal with in his life. Even though Bubba was not the person who released the sex tape, Hogan says it sickens him to know his friend was involved.
